Terms & Conditions

These Terms are an agreement between you and ColdApproach.io LLC, the owner of Cold Approach, whose mailing address is 805 S Miami Ave, Miami, FL 33130, USA. By creating an account, subscribing, buying a course, or booking coaching with Cold Approach, you agree to these Terms & Conditions, the Privacy Policy, the Refund Policy, the Acceptable Use Policy, and the Cookie Policy. If you don't agree to those policies, you should not use the service.

• Courses: unlimited access to the specific course you purchased, no transferable license.
• Coaching (Mentorship Program, Bootcamp, 1-on-1 Calls, Online Dating Mentorship): the specific scope agreed to before payment. Each program has its own scope.
• Done-for-you services (AI Photos, Profile Makeover, Online Dating Concierge): the scope described before checkout or agreed on your application call.
• Community membership: access to our member community for as long as your membership is paid.

You're responsible for keeping your password private and for everything that happens under your account, whether or not you authorized it. If you suspect unauthorized access, change your password and email us immediately at hello@coldapproach.io. We are not liable for losses arising from your failure to protect your credentials.

Payment processors handle all payments. Subscriptions bill weekly, monthly, or yearly, depending on the program, and auto-renew at the then-current price unless you cancel before the next renewal. Pricing for courses and coaching is fixed at the moment of purchase.

To cancel a subscription, email hello@coldapproach.io and tell us why. Cancellation, refund, and reschedule details are in the Refund Policy.

• Our filming: Infield Filming is a separate purchase. It is one hour of filming on your own equipment, followed by a breakdown call of up to one hour. The bootcamp days themselves are not filmed.
• Your own videographer: you may bring one for a fee that depends on how many hours the videographer is there. A full day of 8 hours is $500. The videographer films you only. Your coach and Cold Approach do not appear in the footage and are not named, and the videographer is not coached.
• Our use of footage: we use footage from your sessions only with your written permission.
• Changes on the day: any change is confirmed in writing, by text or email, before it happens.

If you give us your phone number when you book a call, you agree that we may text you about that call and your application from +1 929-209-7870. Message frequency varies. Message and data rates may apply. Reply STOP at any time to stop texts. For help, reply HELP or email hello@coldapproach.io. Carriers are not liable for delayed or undelivered messages. Our Privacy Policy explains how we handle your number.

Use Cold Approach to learn the skill of dating, review your messages and profile, improve your photos, and prepare for dates with people who have already shown interest. The full list of what's allowed and what isn't lives in the Acceptable Use Policy. The short version: don't use anything you learn here to do harm, deceive, coerce, or harass anyone.

You retain ownership of photos, drafts, screenshots, messages, and other material you upload. By uploading, you grant Cold Approach a limited license to process the content for the purpose of providing the service you requested. This license ends when you delete the content or your account, subject to ordinary audit, billing, and legal-retention needs.

Articles, course videos, coaching notes, service frameworks, brand assets, copy, illustrations, and software are owned by Cold Approach (or licensed to it). Your purchase grants you a personal, non-transferable license to consume the material, not to redistribute, repackage, or train models on it. Specifics are in the Acceptable Use Policy.

We may suspend or terminate your account if you violate these Terms or the Acceptable Use Policy. We may email you the reason. You may close your account any time. Refund eligibility is governed by the Refund Policy.

You must be at least 18 years old to use Cold Approach. By creating an account, you represent that you have the legal capacity to enter into these Terms and that all information you provide is accurate and current.

You agree to use Cold Approach only for legitimate personal development and dating improvement. You must not:

• Lie about who you are to the people you meet, such as your age, whether you are single, or photos that are not of you.
• Use Cold Approach to spam, scam, or harass people on dating apps or any other platform.
• Harass, abuse, stalk, or harm other users.
• Use the service for any illegal purpose or to violate any applicable law.
• Attempt to reverse-engineer or extract our proprietary methods.
• Share or redistribute our content without authorization.
• Use automated systems, bots, or scripts to access our service.

We reserve the right to suspend or terminate your account if you violate these standards. Any attempt to circumvent account termination by creating new accounts may result in permanent ban and legal action.

Cold Approach teaches a skill set. We don't guarantee dates, relationships, or any specific result, with one exception: the Online Dating Concierge first-date guarantee, on the exact terms in the Refund Policy. Results depend on what you do with the material. We are not therapists, medical professionals, or a relationship-counseling service; nothing here is a substitute for any of those.

The service is provided "as is" and "as available." We don't warrant that the service will be uninterrupted, error-free, or that it will meet your specific expectations.

To the maximum extent permitted by law, Cold Approach's total liability for any claim arising out of or relating to the service is capped at the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

You agree to indemnify Cold Approach against any claim arising from your misuse of the service, your violation of these Terms or the Acceptable Use Policy, or your interactions with third parties (people you meet, employers, dating platforms) that result from your conduct.

Abuse, harassment, threats, or disrespectful behavior directed at our coaches, support staff, or any team member is not allowed. This includes verbal abuse, threats of violence or legal action used as intimidation, harassment, and discrimination. Violation of this policy may result in immediate account termination without refund.

These Terms are governed by the laws of the State of Illinois, USA, without regard to conflict-of-laws principles.

Any disputes arising from these Terms or your use of Cold Approach that cannot be resolved by good-faith negotiation with hello@coldapproach.io will be resolved by binding arbitration administered by the American Arbitration Association in the State of Illinois. Each party bears its own attorneys' fees and arbitration costs unless otherwise ordered. You waive the right to pursue claims as part of a class action.

All transactions with Cold Approach are final and subject to the Refund Policy. Before initiating any chargeback, payment reversal, or dispute with your card issuer or payment processor, you agree to contact us at hello@coldapproach.io to resolve the issue.

You agree not to initiate, pursue, or threaten any chargeback, payment reversal, payment dispute, or claim with your bank or card network for charges that were legitimately incurred under these Terms and the Refund Policy. Initiating a chargeback or dispute for a legitimate charge without first contacting us violates this agreement, constitutes a material breach of these Terms, and may expose you to legal liability.

In the event of a chargeback or payment dispute, Cold Approach reserves all rights, including the right to: dispute the chargeback directly with the card network or issuer; submit transaction records, access records, communications, and account activity as evidence; suspend or terminate your account and revoke access to all products, services, and content; recover all disputed amounts plus all associated bank fees, card-network fees, payment-processor fees, administrative costs, collection costs, and reasonable attorneys' fees; refer any unpaid balance to a collections agency; and pursue recovery through all available legal remedies, including claims in small claims court or courts of competent jurisdiction.

These remedies are not limited by any other provision of these Terms and are in addition to any other rights available at law or in equity. Nothing in this clause limits your genuine rights under the Refund Policy or any non-waivable consumer-protection law in your jurisdiction.

By using Cold Approach, you represent that you are not located in, nor a resident or national of, any country subject to a U.S. Government embargo or designated as a terrorist-supporting country. You are not on any U.S. Government prohibited or restricted parties list, including the Treasury Department's Specially Designated Nationals List. You will not use Cold Approach in violation of any export control laws or sanctions regulations.

We may update these Terms at any time. Material changes will result in a one-time email notice to active accounts. Minor updates are published directly to this page. Continued use of Cold Approach after a change means you accept the updated Terms. If you do not agree with any changes, you must cancel your account.
